Each of the children (per stirpes) receives a (very)small distribution from a family oil and gas trust. My sister passed away in 2012 and I believe she wanted her portion to go to her daughter, who is age 11, but I don't know if there is anything in a will to verify this wish.
The cheques are so small this year that the executors won't bother to distribute or issue T3s, but they will combine the payment with the 2013 amounts owed next year. The recipients will nevertheless report the income not received on their 2012 taxes.
Questions: Can the 11-year old receive a trust payout, or does it need to be held in trust by someone until she's 18?
Does she have to file a tax return to indicate that she's received the funds?
Does the per stirpes legacy continue to the daughter with or without a will?
I love your blog, thanks for taking the time to educate us!
Anonymousnoreply@blogger.comtag:blogger.com,1999:blog-4402283548766807872.post-21090928200125405942013-04-02T09:44:59.909-04:002013-04-02T09:44:59.909-04:00Chuck, great minds think alike :) Seriously, T-sli...Chuck, great minds think alike :) Seriously, T-slip system needs to be re-jigged IMHOThe Blunt Bean Counterhttps://www.blogger.com/profile/11358868550072516313noreply@blogger.comtag:blogger.com,1999:blog-4402283548766807872.post-18404870319527278162013-04-02T09:36:42.414-04:002013-04-02T09:36:42.414-04:00I'm enjoying the blog. I agree with your suggestion about moving the date up on the T slips...I have a fairly large refund due this year so I was motivated to complete my return early but I was handcuffed waiting for a T-5...which finally came last week. Looking forward to my refund so I can pay my March Break bills!!Chuck Gravellenoreply@blogger.com
